Agreement to Terms
Effective Date: February 27, 2026
Welcome to Vetted (“Vetted,” “we,” “us,” “our”). Vetted is a dating app where women rate men after dates across five categories: Respect, Effort, Conversation, Honesty, and Appearance Accuracy. Date with confidence. Available on iOS and Android (the “App”). These Terms of Service (“Terms”) govern your access to and use of Vetted, including the App, our websites and pages that link to these Terms, and related services, features, content, and communications (collectively, the “Service”).
By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization, and “you” and “your” will refer to both you and that organization.
Important notice about arbitration and class action waiver
These Terms include an agreement to resolve most disputes through binding, individual arbitration instead of court, and a waiver of class actions and jury trials. Please read the Dispute Resolution section carefully. You may have a limited right to opt out of arbitration as described there.
Related policies and additional terms
Your use of the Service is also subject to our Privacy Policy, our Community Guidelines, and our Safety Notice, which are incorporated by reference. If there is a conflict, these Terms control unless we expressly state otherwise.
Changes and additional features
Vetted is evolving. We may add, remove, or modify features (including safety tools, matching logic, and subscription entitlements) as described in these Terms. Sometimes we may offer features labeled “beta,” “preview,” “early access,” or similar; those features may be less reliable, may change without notice, and may be discontinued.
Definitions
To make these Terms easier to read, we use the following definitions. Defined terms may be singular or plural.
- “App” means the Vetted mobile applications for iOS and Android.
- “Content” means any text, photos, images, video, audio, messages, prompts, tags, profile fields, metadata, and other material displayed, uploaded, sent, or otherwise made available through the Service, including User Content and Vetted-provided content.
- “Chat Media” means photos or other media shared in messages.
- “Community Guidelines” means our rules and standards for behavior and Content, available at Community Guidelines.
- “Entitlements” means features or benefits we make available to certain Users, including through Vetted+ (such as Likes You visibility, Super Like, Rewind, Boost, Advanced Filters, and Incognito Mode), subject to availability and these Terms.
- “Incognito Mode” means a feature intended to limit your profile’s visibility in certain parts of the Service, as described in-app. Exact behavior may depend on platform and may change.
- ”Like” means a positive swipe action indicating interest.
- “Match” means a connection created when two Users have mutually indicated interest (for example, when each has “Liked” the other), subject to filters, safety actions, and moderation decisions. A Match enables messaging unless ended.
- “Moderation Status” means the state of an account in our enforcement system, which may include: Active, Suspended, Banned, or Shadow Banned.
- “Pass” means a swipe action indicating you are not interested.
- “Premium Subscription” means a paid subscription to Vetted+ purchased through Apple In-App Purchase or Google Play Billing, which may include Entitlements.
- “Private Photos” means photos placed into consent-gated albums that are not publicly visible on a profile and that require an explicit request and affirmative grant of access by the owner, which can be revoked at any time.
- “Profile” means a User’s public-facing account page, which may include profile photos (up to 6), bio text, prompt answers, interest tags, languages spoken, and other fields that we make available.
- “Rewind” means a feature intended to let you reverse certain recent swipe actions, if available.
- “Safety Check-In” means an optional in-app timer feature intended to help Users remember to check in after an in-person meetup; it is not emergency services.
- “Service” means the App and related services described in these Terms.
- “Super Like” means a premium swipe action intended to signal elevated interest, if available.
- “User” means any person who accesses or uses the Service, including account holders and visitors to any pages that link to these Terms.
- “User Content” means Content that you submit, upload, send, or otherwise make available through the Service.
- “Verification” or “Photo Verification” means our selfie-based liveness check process intended to reduce catfishing, which may result in a “verified” badge.
- “Boost” means a premium feature intended to increase profile visibility for a limited time, if available.
- “Vetted+” means our Premium Subscription offering.
When we say “including,” we mean “including without limitation.”
Eligibility
Age requirement
The Service is for adults only. You must be at least 18 years old to create an account or use the Service. We use technical measures intended to enforce this requirement, including server-side checks, and we may block, suspend, or terminate accounts that appear to be under 18.
No minors. You may not upload, request, share, or possess on the Service any Content that depicts a minor (even if you are the minor in the image), including any content that appears to involve a person under 18. We treat this as a serious safety violation.
Legal capacity and eligibility to contract
You must have the legal capacity to enter a binding contract where you live. If you do not have that capacity, you may not use the Service.
Prior enforcement actions
You may not use the Service if you have been previously banned from Vetted or if you attempt to evade a ban, suspension, or other enforcement action (including by creating a new account or using a different phone number or device).
Sex offender representation
By using the Service, you represent that you are not required to register as a sex offender in any jurisdiction and have not been convicted of a sexual offense involving minors. If this is not true, you may not use the Service.
Geographic availability
While the App may be downloadable in many regions, we may limit functionality based on geographic location or other factors. You are responsible for complying with local laws and regulations that apply to your use of the Service.
Compliance with laws and community standards
You agree to use the Service only for lawful, permitted purposes and in compliance with these Terms, the Community Guidelines, and the Safety Notice. You are responsible for any Content you submit and for your interactions with other Users, on and off the Service.
Account Registration and Security
Account creation and required information
To use most features of the Service, you must create an account. During registration, we may ask you to provide information such as your phone number and other details needed to operate the Service and help keep it safe. Phone number verification is required to reduce abuse and fraud.
Accurate information and profile integrity
You agree to provide accurate, current information and to keep your account details updated. You agree not to misrepresent who you are, where you live, your age, or any other material detail that other Users may reasonably rely on.
You may not create a Profile for someone else, use someone else’s photos without permission, or otherwise impersonate another person or entity.
One account per person
Unless we explicitly allow otherwise in writing, you may have only one account at a time. Creating multiple accounts, sharing accounts, or maintaining “backup” accounts is prohibited and may result in enforcement action.
Account security responsibilities
You are responsible for maintaining the confidentiality of access to your account and devices. Do not share verification codes, passwords, or other credentials with anyone. If you believe your account has been compromised or accessed without authorization, you must notify us promptly at vetted@rezschaefer.com.
Account sharing and delegation
You may not let anyone else use your account or act on your behalf through your account (including to send messages, swipe, request access to Private Photos, or manage subscriptions). You are responsible for all activity that occurs on your account, whether or not you authorized it.
Device and connection limits
To protect the community, we may limit sign-ins, sessions, devices, requests, messages, or other usage patterns. We may also require additional verification steps if we detect suspicious activity.
Location Features
How location is used
Vetted uses location to support matching and help connect users in relevant areas. The Service may use location signals to power matching, feed ranking, and filters. Location filters may change over time and may depend on community usage patterns.
Obligation to keep your profile accurate
You agree to keep your profile and related information accurate. Misrepresenting your location can harm trust and safety (for example, by misleading others about your availability or proximity). If we determine you are misrepresenting your profile, we may take enforcement action, including changing your visibility, limiting features, or suspending or banning your account.
Location verification and anti-spoofing
We may take steps to detect and prevent location spoofing or deception, such as analyzing device signals, network indicators, reported locations, and consistency with account behavior. You agree not to use tools or techniques that hide or falsify your location (for example, GPS spoofing, certain VPN configurations, emulators, automation, or modified clients). If we suspect spoofing, we may restrict or suspend your account, request additional verification, or take other actions to protect the community.
No guarantee of accuracy
Location information can be inaccurate for many reasons (device settings, signal quality, user input, or technical limitations). We do not guarantee that any User’s location or distance information is accurate or up to date.
User Profile and Content
Your responsibility for your Content
You are responsible for the Content you provide and for ensuring it is accurate, lawful, and consistent with these Terms and the Community Guidelines. You are also responsible for how your Content affects others. We may remove or restrict Content or accounts that violate our rules, even if the Content is not unlawful.
Profile requirements and standards
Your Profile is your public presence on Vetted. Your Profile may include up to 6 profile photos, a bio, prompt answers, interest tags, and languages spoken. You agree that:
- Your profile photos must depict you (not someone else), and you must have the rights to use them.
- Your public profile photos must not include nudity or explicit sexual content. (Private Photos have different rules; see Private Photos.)
- Your public profile photos and bio must not depict, reference, or sexualize minors, or include any Content that reasonably appears to involve minors.
- You will not use your Profile to harass, threaten, extort, or discriminate against others, to promote illegal activity, or to solicit money or valuables.
Content categories and different rules
We apply different content standards depending on where Content appears. Examples include:
- Profile Photo: must be appropriate for broad visibility; no minors; no nudity; no hate or threats; must not be misleading.
- Chat Media: must be consensual and lawful; no harassment; no non-consensual intimate imagery; no exploitation; no minors.
- Verification Selfie: must be a live selfie of you; must not be edited to mislead; used for Verification purposes.
- Private Photo: adult-only, consensual, lawful; access controlled by explicit consent and revocable at any time.
The Community Guidelines may provide additional detail and examples. We may update these standards to respond to safety risks.
License you grant to Vetted
You retain ownership of your User Content as between you and Vetted. However, to operate the Service, you grant Vetted a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to host, store, cache, use, reproduce, display, publish, distribute, modify (for technical formatting), perform, and create derivative works of your User Content as necessary to: (a) provide and improve the Service; (b) enforce these Terms and the Community Guidelines; (c) keep the community safe; and (d) develop new features.
This license includes the right to make your Profile Content available to other Users consistent with your settings (for example, visibility controls and location filters). It also includes the right to process User Content using automated systems for purposes such as safety, moderation, and spam prevention. We will handle personal data as described in our Privacy Policy.
Your representations and warranties
You represent and warrant that: (1) you have all rights necessary to provide your User Content to the Service; (2) your User Content does not violate any law or the rights of any third party (including privacy, publicity, intellectual property, or contractual rights); (3) your User Content is not deceptive and does not impersonate another person; and (4) your User Content complies with these Terms and the Community Guidelines.
Right to remove, restrict, or refuse Content
We may remove, restrict, or refuse to display any Content at any time for any reason, including when we believe it violates these Terms, the Community Guidelines, or our safety goals. We may also limit the distribution of Content (for example, by reducing visibility) while we investigate reports or safety signals.
Feedback
If you send us suggestions or feedback, you agree we may use them without restriction or compensation. Feedback helps us improve Vetted for all users.
Private Photos
Consent-gated access model
Vetted allows Users to create Private Photos albums that are not visible by default. Private Photos are optional. If you choose to use Private Photos, you agree to the consent model described in this section.
Private Photos access requires explicit consent: another User must request access, and you must affirmatively grant access before they can view your Private Photos. Access is not automatic, is not implied by messaging or matching, and must be granted separately.
Revocation and control
You may revoke a User’s access to your Private Photos at any time, for any reason, through the controls we provide. Revocation should take effect within a reasonable time. Because technology is complex (including caching and network delays), we cannot guarantee instantaneous removal in every circumstance, but we design the system so that access is intended to stop promptly once revoked.
Strict prohibitions on redistribution and capture
Private Photos are shared based on trust and explicit consent. You agree that you will not, and will not attempt to:
- Download, copy, save, record, screen-capture, screenshot, photograph, or otherwise reproduce another User’s Private Photos.
- Share another User’s Private Photos with anyone else, whether online or offline.
- Use another User’s Private Photos to harass, threaten, blackmail, extort, out, or otherwise harm them.
Any redistribution or capture of Private Photos without explicit permission is a serious violation and may result in immediate enforcement action, including permanent ban, and may also expose you to legal liability.
Content standards for Private Photos
Private Photos may depict adult nudity or sexual content only if it is lawful and consensual. You agree that Private Photos (and any associated captions) must not include:
- Any depiction of a minor or anyone who appears to be under 18.
- Non-consensual intimate imagery, voyeuristic content, hidden-camera content, or content taken without the subject’s knowledge and consent.
- Sexual exploitation, trafficking, or coercion (including images connected to sextortion or threats).
- Content involving force, serious violence, or the promotion of non-consensual acts.
- Content that violates the privacy rights of others (for example, including someone’s face or identifying details without permission).
License scope for Private Photos
Private Photos remain your User Content and you retain ownership, but because Private Photos are particularly sensitive, we limit our use to what is necessary to operate, secure, and enforce the Service. You grant us the license described in User Profile and Content, but we do not use Private Photos for advertising or promotional materials without your explicit consent.
Enforcement and investigations
We may use automated tools and human review to investigate suspected abuse involving Private Photos, including reports of non-consensual sharing or exploitation. If we determine you violated this section, we may remove Content, suspend or ban your account, preserve evidence, and cooperate with law enforcement where appropriate.
Photo Verification
Purpose of Verification
Photo Verification is intended to reduce catfishing and increase confidence that a Profile is controlled by a real person who can complete a selfie-based liveness check. Verification is optional unless we require it for certain features or in response to safety concerns.
How Verification works
Verification typically involves submitting a selfie and completing a liveness check designed to confirm the presence of a live person. We may compare the verification selfie to profile photos to assess consistency. If your Verification is approved, we may display a verification badge on your Profile.
What the badge means (and does not mean)
A verification badge means only that, at a point in time, the account completed our verification process. It is not a guarantee of identity, age, name, background, intent, relationship status, or safety. Verification does not replace good judgment, and it does not eliminate risk in online or offline interactions. Please review our Safety Notice.
Verification data handling
Verification involves processing biometric-like information (a face image) for the limited purposes of running the liveness check, preventing fraud, and enforcing safety rules. We handle personal data in accordance with our Privacy Policy. We may retain verification records as needed for security, abuse prevention, and auditability, consistent with the Privacy Policy and applicable law.
Re-verification and removal
We may require re-verification if we detect suspicious activity, if you significantly change your Profile photos, if reports suggest impersonation, or if we update our verification methods. We may also remove a badge if we believe it is being misused, if the underlying account is not in good standing, or if we cannot confirm continued compliance.
No obligation to verify others
We do not promise to verify any particular User or to provide a verified-only experience. Availability of Verification may vary by region, device, and technical constraints.
Matching and Interactions
How matching generally works
Vetted is designed to help Users connect. While the specific experience may evolve, a Match generally forms when two Users mutually express interest (for example, by each selecting “Like”). Once you Match, you may be able to message each other unless the Match is ended.
Signals used for ranking and recommendations
We may use a combination of signals to recommend Profiles and order results, including: location proximity, dating intent (Serious, Casual, Friends, Activity Partner), mutual preferences, activity patterns, and safety-related signals (such as blocks or reports).
We may use geospatial technologies and databases to support location-based features. Distance and location information may be approximate and may not reflect real-world availability or travel time.
Swipe actions and feature availability
The Service may offer swipe actions such as Like and Pass, and premium actions such as Super Like, Rewind, and Boost (some of which may require Vetted+). Availability, limits, cooldowns, and mechanics may vary over time, by region, or by subscription tier.
No guarantee of matches or outcomes
We do not guarantee that you will receive matches, messages, dates, relationships, friends, activity partners, or any particular outcome. Your experience depends on many factors, including other Users’ choices and community dynamics.
Algorithm changes and experimentation
We may modify matching algorithms, filters, and ranking systems to improve the Service, reduce harm, and respond to abuse. This may include A/B testing, feature experiments, and adjustments to how Profiles are shown. We may also limit the visibility of certain content, actions, or accounts for safety.
How matches can end
A Match can end for many reasons, including: either User unmatching (if available), blocking, account deletion, suspension, ban, or other enforcement actions. When a Match ends, messaging access may end and certain message history may become inaccessible, subject to retention described in the Privacy Policy.
Messaging
Messaging eligibility
Messaging is generally available only between Users who have matched. You agree not to attempt to circumvent messaging restrictions (for example, by spamming users through profiles, prompts, or external links).
Real-time delivery and limitations
The Service may provide real-time messaging features such as typing indicators, presence, and read receipts. These features rely on network connections and device behavior and may be inaccurate, delayed, or unavailable. We do not guarantee message delivery, delivery time, or that read receipts or presence indicators reflect real-world behavior.
Standards for messages and chat media
All messages and Chat Media must comply with these Terms and the Community Guidelines. In particular, you may not send:
- Threats, harassment, hate speech, or repeated unwanted sexual messages.
- Scams, fraud, spam, or phishing attempts (including requests for money, gift cards, or financial account access).
- Non-consensual intimate imagery or content intended to shame, out, or blackmail someone.
- Content involving minors or anyone who appears to be under 18.
Review of reported messages
We do not actively monitor all messages. However, we may review messages and Chat Media when they are reported, when required to enforce safety rules, or when we detect signals of abuse (for example, spam patterns). You consent to this review for safety and enforcement purposes.
Message retention
We retain messages and Chat Media for as long as needed to operate the Service, support features like sync across devices, and enforce safety and legal obligations. Retention periods may vary depending on factors such as reports, investigations, and legal requirements. For more detail, see the Privacy Policy.
No substitute for emergency services
Messaging and any Safety features are not emergency response. If you are in immediate danger, call local emergency services.
Prohibited Conduct
Vetted is a community focused on building trust in dating. To protect Users and keep the Service safe, you agree not to do any of the following on or through the Service, and not to encourage or help others do so:
Harassment, hate, and harm
- Harass, stalk, bully, intimidate, or target others with repeated unwanted contact.
- Use hate speech or demean others based on protected characteristics (including sexual orientation, gender identity, race, ethnicity, nationality, religion, disability, or age).
- Threaten violence, self-harm, or harm to others, including threats to out someone or harm their reputation, job, or family.
- Engage in or promote exploitation, trafficking, or coercion.
Sexual misconduct and consent violations
- Share or threaten to share intimate images without consent, including content from Private Photos or Chat Media.
- Engage in sextortion, blackmail, or coercion (including demanding Private Photos, money, or favors).
- Share content depicting minors or anyone who appears under 18, or attempt to interact with minors.
- Share content that celebrates or promotes non-consensual sexual acts or violence.
Deception, impersonation, and fraud
- Impersonate any person or entity, or misrepresent your identity, age, location, relationship status, or intentions.
- Catfish, use someone else’s photos, or operate an account on behalf of someone else.
- Run scams, solicit money or valuables, or mislead users into off-platform transactions.
- Send spam, bulk messages, or repetitive solicitations, including advertising unrelated services.
Illegal activity and unsafe commerce
- Use the Service to facilitate illegal activity, including drug dealing, exploitation, or trafficking.
- Promote or sell illegal goods or services, or attempt to recruit others into illegal schemes.
- Share instructions that meaningfully facilitate violent wrongdoing or other serious illegal acts.
Privacy invasion and doxxing
- Doxx other Users or share personal identifying information without permission (for example, home address, workplace, government IDs, private phone number, or family details).
- Record calls or meetings without consent where consent is required.
- Use the Service to surveil, track, or monitor another person.
Platform abuse and technical misuse
- Attempt to reverse engineer, decompile, disassemble, or otherwise derive source code from the Service, except where prohibited by law.
- Use bots, scripts, automation, scrapers, or unauthorized third-party clients to access the Service or to collect data from it.
- Bypass rate limits, attempt to probe or scan our systems, or interfere with the Service’s performance or security.
- Circumvent safety features, including blocks, reports, location checks, moderation actions, or subscription restrictions.
- Create multiple accounts, evade bans, or share accounts.
Abuse of reporting and safety tools
- Submit false reports in bad faith or to retaliate against someone.
- Misuse Safety Check-In or other Safety features to harass, threaten, or manipulate others.
Violation of this section may result in enforcement action as described in Safety and Enforcement.
Safety and Enforcement
Safety-first approach
Our moderation philosophy is simple: safety over growth. We would rather remove harmful behavior than maximize engagement. We enforce these Terms and the Community Guidelines to help protect all Users.
Moderation statuses
Accounts may be assigned a Moderation Status, which can affect access and visibility:
- Active: normal access, subject to rules and feature limits.
- Suspended: temporary restriction of access while we investigate or due to a policy violation.
- Banned: permanent removal from the Service (or long-term removal), typically for serious or repeated violations.
- Shadow Banned: reduced distribution or limited visibility intended to mitigate harm (for example, limiting how often your Profile appears to others). Shadow bans may be used for suspected spam, bot-like behavior, or safety risks and may be applied without notice.
Enforcement actions we may take
We may take one or more actions, with or without notice, depending on severity and risk:
- Warnings and education prompts
- Content removal or restriction (including removing photos, prompts, or Chat Media)
- Feature restrictions (for example, limiting swipes, messaging, or access to Private Photos)
- Match or conversation removal
- Temporary suspension
- Permanent ban
- Device, phone number, or other identifiers may be blocked to prevent ban evasion
Zero-tolerance behaviors
Certain behaviors may result in immediate suspension or permanent ban, including: content involving minors; sexual exploitation; credible threats of violence; sextortion; non-consensual intimate imagery; repeated harassment; hate-based targeting; and ban evasion.
Automated and human review
We may use a mix of automated systems and human review to detect and address abuse, including spam detection, fraud signals, and pattern analysis. Automation can make mistakes. We may provide appeal processes in-app or by email in some cases, but we are not required to reinstate any account.
Block and report tools
Block: When you block someone, the block is intended to be immediate, bidirectional, and silent (the other User is not notified). Blocks generally prevent further messaging and visibility between the accounts.
Report: You can report Users and Content with a reason and optional free-text context. Reports help us investigate patterns of harm. We may contact you for additional information, but we may not be able to share the outcome due to privacy and safety considerations.
Safety Check-In and Safety Center
Vetted may provide a Safety Check-In timer for meetups. If you set a timer and do not dismiss it, the system may trigger an escalation flow (for example, reminders or other in-app actions). Safety Check-In is not emergency services and is not a guarantee of safety. Do not rely on it as your only safety plan. Cooperation with law enforcement and evidence preservation
We may preserve evidence, including Content and logs, when we reasonably believe it is necessary to comply with law, enforce these Terms, or respond to harm. We may cooperate with law enforcement requests as required or permitted by law.
Child safety and CSAM reporting
We do not allow content involving minors. If we become aware of content that appears to involve child sexual abuse material (CSAM) or exploitation of minors, we may remove it, ban the account, preserve evidence, and report it to appropriate authorities, including the National Center for Missing & Exploited Children (NCMEC), as applicable.
No duty to monitor
We are not obligated to monitor all Content or behavior, but we reserve the right to do so and to take action. Your responsibility to follow these Terms applies whether or not we actively monitor a particular interaction.
Intellectual Property
Ownership of the Service
The Service, including its software, design, algorithms, ranking systems, trademarks, logos, and other materials (excluding User Content), is owned by Vetted and/or its licensors and is protected by intellectual property laws. “Vetted” and related branding are trademarks or trade dress of Vetted.
Limited license to you
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use the App and access the Service for your personal, non-commercial use. This license does not allow you to copy, modify, distribute, sell, lease, or create derivative works of the Service.
Your content
You retain ownership of your User Content, but you grant us the license described in User Profile and Content. You also agree not to use other Users’ content except as permitted by the Service and these Terms, and you agree not to reproduce or redistribute it outside the Service without explicit permission.
Restrictions on use of branding
You may not use Vetted’s name, logo, or branding without our prior written permission, except for fair use or other rights you may have under applicable law.
DMCA and copyright complaints
We respect intellectual property rights. If you believe Content on the Service infringes your copyright, you may send a notice requesting removal. A compliant notice typically includes: your contact information; identification of the copyrighted work; identification of the allegedly infringing material and where it appears; a statement that you have a good-faith belief the use is not authorized; and a statement made under penalty of perjury that the information is accurate and you are authorized to act.
You may send copyright notices to: vetted@rezschaefer.com (Subject: “DMCA Notice”). If we remove Content in response to a copyright notice, we may notify the User who posted it and may accept counter-notifications as permitted by law.
Repeat infringer policy
In appropriate circumstances, we may terminate accounts of Users who are repeat infringers.
Third-Party Services
App stores and device platforms
Your use of the App is subject to the terms and policies of the platform from which you download it (for example, Apple’s App Store or Google Play). Those platforms may have their own rules about payments, subscriptions, refunds, and device permissions.
Authentication, infrastructure, and vendors
The Service may rely on third-party services to function, such as:
- Authentication: identity and access systems (for example, AWS Cognito) and phone verification providers.
- Hosting and storage: cloud infrastructure (for example, AWS), databases, caching, and content delivery networks.
- Networking and security: DNS and traffic protection services (for example, Cloudflare).
- Diagnostics and reliability: error tracking and monitoring (for example, Sentry) and observability tooling.
Third-party services may experience outages or changes. We are not responsible for third-party services over which we do not control.
External links and resources

Privacy
Privacy Policy controls
Our Privacy Policy explains how we collect, use, share, and retain information when you use the Service. By using the Service, you consent to the practices described in the Privacy Policy.
Data needed to operate a location-based dating service
Vetted is location-based and uses location information to help deliver matches and safety features. This may require processing location signals and related metadata. You control certain settings on your device and in the App, and some features may not work if you do not provide required permissions or data.
No sale of personal data
We do not sell your personal data to third parties. We may share certain information with service providers who help us operate the Service, consistent with the Privacy Policy.
Communications
You agree that we may contact you through the App, by email, or by SMS for purposes such as account verification, security, safety, support, legal notices, and updates to the Service. Standard message and data rates may apply for SMS.
Disclaimers
Service provided as-is
The Service is provided on an “AS IS” and “AS AVAILABLE” basis. To the fullest extent permitted by law, Vetted disclaims all warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade.
No guarantee of matches, connections, or outcomes
We do not promise any number of matches, messages, dates, relationships, friendships, or activity partners. We do not guarantee that any User will respond to you, that a Match will continue, or that you will be compatible with any User.
No background checks; no guarantee of identity
We do not conduct background checks on Users and do not guarantee that Users are who they claim to be. Photo Verification (if available) is not identity verification and is not a safety guarantee. You are responsible for using your judgment and taking precautions, including reviewing our Safety Notice.
Online and offline risk
You assume all risks associated with: (a) your interactions with other Users, including in-person meetups; (b) any content you choose to share; and (c) any decisions you make based on information in Profiles, messages, or verification badges.
Availability, errors, and interruptions
We do not guarantee uninterrupted or error-free operation. The Service may experience downtime, delays, bugs, data loss, or security incidents. Features may not work on all devices or in all locations. We may suspend the Service for maintenance or for safety reasons.
Safety tools are not emergency services
Safety features (including block/report tools, Safety Check-In, and Safety Center resources) are not emergency services and may not prevent harm. If you are in danger, contact emergency services immediately.
Limitation of Liability
To the fullest extent permitted by law, Vetted and its operator, affiliates (if any), and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or related to your use of (or inability to use) the Service, even if we have been advised of the possibility of such damages.
Liability cap
To the fullest extent permitted by law, the total liability of Vetted for any claim arising out of or relating to the Service or these Terms will not exceed the greater of: (a) the amounts you paid to Vetted for the Service in the 12 months immediately preceding the event giving rise to the claim; or (b) $100 if you have not paid Vetted in that period.
Scope and exceptions
The limitations in this section apply to all theories of liability (contract, tort, negligence, strict liability, or otherwise) and regardless of whether any limited remedy fails of its essential purpose.
Some jurisdictions do not allow the exclusion or limitation of certain damages or liability. In those jurisdictions, our liability will be limited to the maximum extent permitted by law.
Indemnification
You agree to indemnify, defend, and hold harmless Vetted and its operator from and against any claims, demands, losses, liabilities, damages, judgments, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Service; (b) your User Content; (c) your interactions with other Users (including offline interactions); (d) your violation of these Terms, the Community Guidelines, or the Privacy Policy; or (e) your violation of any law or the rights of any third party (including intellectual property, privacy, or publicity rights).
Defense and cooperation
We may assume the defense of any matter subject to indemnification, in which case you agree to cooperate with our defense. You may not settle any claim without our prior written consent if the settlement imposes liability or obligations on Vetted.
Dispute Resolution
Informal resolution first
Before starting arbitration or a court proceeding (except for small claims where allowed), you agree to try to resolve the dispute informally. You must send us a written notice describing the dispute and the relief you seek (“Notice of Dispute”) to vetted@rezschaefer.com with the subject line “Notice of Dispute.”
You and Vetted agree to attempt to resolve the dispute in good faith for 30 days after we receive the Notice of Dispute. If the dispute is not resolved within that period, either party may proceed as described below.
Agreement to binding arbitration
Except as described in “Exceptions,” you and Vetted agree to resolve any dispute, claim, or controversy arising out of or relating to the Service or these Terms through binding, individual arbitration. This includes disputes based on contract, tort, statute, fraud, misrepresentation, or any other legal theory.
Arbitration rules and administrator
The arbitration will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules or other applicable AAA rules, unless you and Vetted agree otherwise. The arbitrator will have authority to decide issues of arbitrability, and to award the same remedies a court could award, subject to these Terms.
Location and format
Unless the parties agree otherwise, arbitration will take place in a mutually agreed location, or may be conducted remotely (by phone or video) where appropriate. The arbitrator may allow written submissions instead of a hearing in appropriate cases.
Individual basis only; class action waiver
You and Vetted agree that disputes will be brought only on an individual basis. Neither you nor Vetted will seek to have any dispute heard as a class action, private attorney general action, or in any other proceeding where either party acts or proposes to act in a representative capacity.
You and Vetted waive any right to a jury trial.
Exceptions
The following are exceptions to the arbitration requirement:
- Small claims: Either party may bring an individual action in small claims court if it qualifies and remains in that court.
- IP and platform abuse: Either party may seek injunctive or equitable relief in court for claims related to intellectual property infringement, unauthorized scraping, reverse engineering, or other misuse that threatens the security or integrity of the Service.
Opt-out of arbitration
You may opt out of this arbitration agreement by sending an email to vetted@rezschaefer.com within 30 days of your first use of the Service. Your opt-out notice must include: your full name, the phone number associated with your Vetted account, and a clear statement that you are opting out of arbitration. If you opt out, disputes will be resolved in court as described in Governing Law and Jurisdiction.
Severability of dispute terms
If a court or arbitrator determines that the class action waiver is unenforceable for a particular claim, then that claim must be litigated in court (not arbitrated) on an individual basis, and the remaining portions of this Dispute Resolution section will remain in effect to the fullest extent permitted by law.
Time limit on claims
To the extent permitted by law, any claim must be brought within one year after the claim arose, unless a longer period is required by law.
Governing Law and Jurisdiction
These Terms and any dispute arising out of or relating to the Service will be governed by the laws of the State of Delaware and applicable federal law of the United States, without regard to conflict-of-law principles.
Except where arbitration applies, you and Vetted agree that any judicial proceeding will be brought in the state or federal courts located in Delaware, and you consent to personal jurisdiction and venue in those courts.
Modifications to Terms
Right to update Terms
We may update these Terms from time to time to reflect changes in the Service, safety practices, legal requirements, or other factors. When we update the Terms, we will update the “Effective Date” at the top of the Terms and may provide notice through the App, by email, or on our website.
Material changes
If we make a material change, we will make reasonable efforts to provide prominent notice. Your continued use of the Service after the updated Terms take effect means you accept the updated Terms. If you do not agree to updated Terms, you must stop using the Service and may delete your account.
Archived versions
We may maintain prior versions for reference, but we are not obligated to do so. The version marked with the most recent Effective Date controls.
Modifications to Service
Service changes and feature availability
We may modify, suspend, or discontinue any part of the Service at any time, including features such as matching filters, messaging, Private Photos, Verification, swipe actions, or Safety tools. We may also limit functionality by region, device type, OS version, or other factors.
Maintenance and downtime
We may perform maintenance that affects availability, including updates to improve safety, reliability, and performance. We are not liable for any downtime or loss of access resulting from maintenance or changes.
Changes affecting subscriptions
If you have a Premium Subscription, we may change Entitlements, limits, or the way features work, as described in Premium Subscriptions and Purchases. We do not guarantee that any feature will remain available indefinitely. If you do not agree with changes, your remedy is to cancel your subscription through Apple or Google and stop using the Service.
Termination
Account deletion by you
You may delete your account at any time through the in-app settings (if available). Deleting your account may remove your Profile from the Service and may affect access to messages and matches. Data deletion and retention are described in the Privacy Policy.
Termination or suspension by Vetted
We may suspend or terminate your account, restrict features, or remove Content at any time if we believe you violated these Terms, the Community Guidelines, or if your behavior creates risk or harm to other Users or to the Service. We may do so with or without notice, especially in urgent safety situations.
Effects of termination
Upon termination, your right to use the Service ends. You may lose access to matches, messages, and Content. If you have a Premium Subscription, termination may result in forfeiture of remaining subscription time to the extent permitted by platform policies and applicable law. Subscription management remains subject to Apple or Google processes.
Survival
The following sections (and any other provisions that by their nature should survive) will survive termination: Agreement to Terms (as to dispute provisions), User Profile and Content (license grants), Private Photos (restrictions), Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Dispute Resolution, Governing Law and Jurisdiction, and miscellaneous provisions below.
Severability
If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.
Entire Agreement
These Terms, together with the Privacy Policy, the Community Guidelines, and any additional terms or policies we present to you for specific features, form the entire agreement between you and Vetted regarding the Service and supersede any prior or contemporaneous agreements, communications, or understandings.
Assignment
You may not assign, transfer, or sublicense your rights or obligations under these Terms without our prior written consent. We may assign these Terms (in whole or in part) without restriction, including in connection with a reorganization, asset transfer, or acquisition, subject to applicable law.
Waiver
If we do not enforce a provision of these Terms, that does not mean we waive our right to enforce it later. Any waiver must be in writing and signed by Vetted to be effective.
